Ethics

What the difference between a solider and a driver who hits a person? An ethical debate between me and my brother. I don't see the different between them. One kills a enemy in battle the other kills a person by accident and runs in panic. On doesn't admit they done it, the other is trained to kill and keep going without thinking. Who is in the wrong?
